What Accidents are Compensable?
An accident is compensable to an employee when the accident arose out of and in the course of his/her employment and results in a condition of ill-being causally related to same.
What this means is when the duties a person performs causes an injury, and the job was unique enough so that it exposed the worker to dangers greater than that experienced by the general public. One of the most common defenses used by Insurance Companies is to claim that the worker was not exposed to any dangers greater than that of the general public.
Other claims that may be compensable are injuries that may have developed over a long period of time and are generally referred to as “repetitive trauma” cases. Repetitive trauma cases can sometimes be more difficult to prove than those injuries which occur at one particular point in time. Once again, the earlier these issues are addressed, the easier it is to have a successful outcome.
